From cops to courts, confusion over Alabama law (AP)

BIRMINGHAM, Ala. ? Alabama's tough new law on illegal immigration was complicated even before the courts got involved. Now that federal judges have blocked parts of the act while letting others take effect, officials say uncertainty reigns even while suspects are being arrested and jailed.

Court cases can vary from one place to the other, depending on how local police apply the law to arrest suspects. Once those suspects get to court, the handling of their cases can vary from judge to judge in the state's more than 450 trial courts at the municipal and county level.

"There's a whole lot of confusion about the law and what we should do about it," said Judge Scott Vowell, a circuit judge in Birmingham's Jefferson County and president of the Alabama Circuit Judges Association.

He said he has a list of troubling reports: In some areas, police are setting up roadblocks near mobile home communities where Hispanic people live. One municipal judge opened court by saying that anyone without a driver's license would be arrested under the law. Another judge told spectators that the need for a translator could be considered evidence against someone.

Other cases of mixed signals are easy to find.

In the north Alabama city of Decatur, four people were arrested on charges of failing to have proper documents and pleaded guilty within hours under a part of the law a federal court has since struck down. The same day in Jemison, a judge threw out a similar charge against a man because the defendant already was free on bond from a federal immigration court.

Court administrators' interpretation of a key part of the law was challenged by a judge in one instance, and a lawyer tried and failed to use the month-old law to throw out a contract reached in May 2010 between a car seller and two purchasers who were living in the country illegally.

Alabama's top law enforcement official, Attorney General Luther Strange, said many people who are uncertain about the law haven't even read it. While some say the federal court decisions added to the confusion, Strange said they may have instead helped by placing some sections on hold.

"I think it will give people a chance to take a breath and read the provisions," said Strange, whose office is defending the act in court.

State officials are trying to clear up some of the questions through training that began only after the law took effect. The Administrative Office of Courts has sent memos and emails to judges explaining the law, and the Alabama Department of Homeland Security provided an overview for police at a meeting organized by Strange's office.

On Friday, the Alabama District Attorneys Association will hold a meeting for prosecutors in hopes of developing a blueprint for statewide training for law enforcement. Executive director Randy Hillman said many local agencies still aren't enforcing the law because of uncertainty over exactly what it says.

"Right now people don't know how to apply it," Hillman said. "We're feeling our way. It's not that it's not doable, it's just that it's difficult."

Susan Fuqua, the head of a state organization for municipal court officials, said training sessions and legal advice from Montgomery help, but courts constantly disagree over how to enforce laws. Court rulings yet to come could complicate the situation even further, she said.

"There are over 170 municipal courts in Alabama. There are judges there, and they might be on different pages on how to handle it. Are they all in agreement? I can't answer that," said Fuqua, president of the Alabama Municipal Court Clerks and Magistrates Association.

Passed by the Republican-controlled Legislature and signed by GOP Gov. Robert Bentley, the 72-page, 34-section law is considered the nation's toughest crackdown on illegal immigration by both supporters and opponents. It covers a wide range of everyday life, from making it illegal to give an illegal immigrant a ride and requiring schools to check students' citizenship status to barring contracts with illegal immigrants and making them carry documents.

The law originally was set to take effect Sept. 1, but U.S. District Judge Sharon Blackburn blocked implementation while considering challenges from the Justice Department, immigrant rights groups, religious leaders and others. She finally let some sections take effect on Sept. 29 but blocked others, and the 11th U.S. Circuit Court of Appeals then blocked more of it this month.

As lawyers sorted through the court opinions, some police agencies delayed enforcement. Fuqua said police haven't filed any cases in the municipal court she oversees in the Birmingham suburb of Hoover, but other cities already are prosecuting people.

The four illegal immigrants arrested in Decatur during a pair of traffic stops pleaded guilty on Oct. 10 within hours of their detention under a section of the law that created a misdemeanor offense for anyone who was in the country illegally and failed to carry an alien registration document.

Each was ordered to pay $296 in fines and fees and transferred to the custody of federal immigration officials, even though the 11th U.S. Circuit Court of Appeals blocked enforcement of that section of the law four days later.

Municipal court officials said none of the four appealed their convictions, but a defense attorney who represented them did not return messages seeking comment.

Meanwhile, a judge in the central town of Jemison was throwing out the case against a man who was arrested on a similar charge of failing to have documents. His lawyer, Freddy Rubio, argued that the law was unclear and his client was legally in the United States because he was free on bond while challenging a deportation order from a federal immigration judge.

Rubio, an American Civil Liberties Union board member who is part of the coalition challenging the new law, said he has spent years representing immigrant clients yet still isn't sure exactly which parts of the law are now in effect and exactly what they mean.

"It's a mess. It was so big, no one is sure what it is now," he said.

Vowell, the head of the judges' association, agrees.

"Judges need to make an effort to apply the law the same around the state, and that's certainly difficult because of the ambiguity of the law and the opinions that have been issued by the federal courts that have addressed the law," he said. "Some of it will just have to be addressed on a case-by-case basis."

Review: 'Uncharted 3' another interactive treasure (AP)

It was somewhere around the sixth rooftop that I leapt from during a rollicking foot chase above the streets of Yemen that I realized "Uncharted 3: Drake's Deception" (Sony, $59.99 for PlayStation 3) is one of the best games I've played this year ? and maybe ever.

It's not because the gameplay is notably innovative or the story is particularly compelling. They're not. "Uncharted 3" is just unapologetically fun. The developers at Naughty Dog have stuck closely to the formula that garnered them awards, critical praise and game sales for "Uncharted 2: Among Thieves" by creating another interactive action experience that rivals anything Hollywood has churned out in the past four years.

"Uncharted 3" finds treasure hunter Nathan Drake, who claims to be a descendent of Sir Francis Drake, on a quest to uncover a mythical city known as the "Atlantis of the Sands" that's apparently buried somewhere in the Middle East. His journey is more personal this time, providing some much needed character development for Drake and his cohorts.

Nolan North again gives a pitch-perfect performance as Drake, and so do sidekicks Richard McGonagle as con man Victor "Sully" Sullivan, Emily Rose as journalist Elena Fisher, Claudia Black as grifter Chloe Frazer and Graham McTavish as henchman Charlie Cutter. Rosalind Ayres does a noble Helen Mirren impersonation as villainess Katherine Marlowe.

The game's exotic environments serve as the other, more gorgeous, stars of "Uncharted 3." A burning chateau in France, a pirated cruise ship in the Arabian Sea and the bustling streets in Yemen are a few of the exhilarating playgrounds where Drake can seamlessly switch among climbing, shooting, brawling and puzzle solving during his whirlwind adventure.

Yes, the plot is too similar to the previous "Uncharted" titles ? how many secret cities can one man uncover? But the pace is so rapid, and the action is peppered with so much humor and heart, that it hardly matters, especially in the game's more exciting later stages, some of which are surprisingly mind-bending and gut-wrenching for such a mainstream game.

"Uncharted 3" doesn't offer players any more freedom than its predecessor did two years ago, which is just fine by me because that's what the developers intended. I found the strict linear nature of "Uncharted 3" comforting after toying with such seemingly open-ended new releases as "Rage," "Dark Souls" and "Batman: Arkham City."

The only major gripe that I have with "Uncharted 3" is that it's no longer in uncharted territory. The differences from the second to the third installment are merely tweaks. The hand-to-hand combat system is sharper, and the multiplayer and cooperative modes are fuller, but they still lack the addictiveness of games like "Call of Duty" or "World of Warcraft."

The bar was set so high that "Uncharted 3" isn't quite able to surpass "Uncharted 2," despite a masterful blend of thrilling gameplay, cinematic storytelling and luscious graphics. I wonder if it's possible for Naughty Dog to ever top "Uncharted 2." I'm not sure. I just know I cannot wait to play "Uncharted 4" to find out. Four out of four stars.

Motorola Pro+ 4G rides into Canada November 7th, will kick off shoes and stay a while


We knew it was planning to grace Europe and Asia with its presence this month, but now we're hearing the Motorola Pro+ 4G is ready to make its North American debut at Bell Canada. We're not seeing any large differences here compared to the overseas model, though the addition of "4G" to the title is an obvious exception. The device offers a 1GHz CPU, 512MB of RAM, Android 2.3, a 5MP camera, 3.1-inch VGA (640 x 480) display with Gorilla Glass, HSPA 14.4 (hence the "4G" name) and a lot of Enterprise-friendly security features. We know it'll be hitting shelves on November 7th, but no price has been announced so far. To find out the full shebang, head south for the press release.

Update: We've confirmed with an inside source that it'll sell for $349.95, but there's no word on whether subsidies will apply for long-term contracts.

(AP) ? If the United States and Pakistan ever went to war, Afghan President Hamid Karzai says Afghanistan would back neighboring Pakistan.

Karzai made the comment to the private GEO television station in Pakistan in an interview broadcast on Saturday.

It is a surprising remark given Karzai's recent criticism of Pakistan and his show of alliance with the United States during U.S. Secretary of State Hillary Rodham Clinton's visit to Kabul last week. Both Clinton and Karzai vocally accused the Pakistan government of providing sanctuary to terrorist groups launching attacks in Afghanistan.

A military conflict between the U.S. and Pakistan is not likely, but Karzai says that if Pakistan were attacked and asked for Afghanistan's help, the Afghans would support the Pakistanis.

Will Ferrell wins nation's top humor prize in DC

(AP) ? The "Saturday Night Live" star who perfected his impersonation of "President George W. Bush" and later took his presidential act to Broadway is receiving the nation's top humor prize Sunday night in Washington.

Will Ferrell was expected to receive the Mark Twain Prize for American Humor at the Kennedy Center for the Performing Arts, with performances from Jack Black, Conan O'Brien, Larry King and the rock band Green Day in his honor. They will be joined by Maya Rudolph, Molly Shannon and Lorne Michaels from Ferrell's "SNL" days. The show will be taped for broadcast Oct. 31 on PBS stations nationwide.

When the award was announced in May, Ferrell said he would begin "cultivating a Mark Twain-esque mustache" for the event. He was spotted Friday in the White House press briefing room ahead of Sunday night's ceremony, though there was no word on the state of his mustache.

On the red carpet, Ferrell said he's proud to win the Twain Prize because it's the "only legit" comedy prize that "puts the emphasis on humor and how hard it is."

Ferrell said playing the Bush character is one of his favorite memories for its political laughs, especially when he took the character to Broadway.

"We hit it at the perfect time when people wanted some sort of comedy after the eight years we just went through."

Shannon said she has known Ferrell since before "SNL." She said contrary to his TV persona, Ferrell is very serious and sweet to work with.

"He can really see people," she said.

Ferrell is the son of a teacher and Roy Lee Ferrell, a guitarist for the Righteous Brothers. He grew up in Irvine, Calif., went to college at the University of Southern California and got his start in comedy with the Los Angeles improv group, The Groundlings.

That's where he was discovered by "SNL." He starred for seven seasons on the NBC series, with memorable characters that included "Craig the Spartan Cheerleader," a middle school music teacher named "Marty Culp" and impressions of Janet Reno, Alex Trebek and Neil Diamond.

Ferrell went on to make some outlandish movies including "Anchorman: The Legend of Ron Burgundy," ''Talladega Nights: The Ballad of Ricky Bobby" and "Old School." More recently he tried his hand at drama with this year's independent film "Everything Must Go." He has also made a Spanish-language comedy, "Casa de Mi Padre."

Ferrell told the AP he has tried different avenues as movie studio budgets tightened. He opted for projects with smaller budgets but more creative freedom.

In 2009, Ferrell revived his Bush character with a one-man Broadway show "You're Welcome America. A Final Night with George W. Bush," which was nominated for a Tony Award. He later performed the show live on HBO.

Longtime collaborator Adam McKay and Ferrell also took their comedy to the Internet with the 2007 creation of the popular video website FunnyorDie.com. Since then, it has drawn an audience of millions for its original Web programming.

Thirteen other people have won the Mark Twain Prize since 1998, including Tina Fey, Bill Cosby, Steve Martin and Whoopi Goldberg. It recognizes people who have followed the tradition of Samuel Clemens, the writer known as Mark Twain who used social commentary and satire to have an impact on society.

Ohio governor cracks down on exotic pets

Gov. John Kasich on Friday signed an executive order cracking down on dangerous exotic pets, just days after an animal collector set dozens free and committed suicide.

The order does not ban sale or ownership of wild animals, but allows authorities to use existing legal authority ? including arrest powers available to county humane society officers ? to deal with exotic animal issues, according to The Columbus Dispatch.

Wild-animal auctions will be restricted and unauthorized auctions will be shut down.

Kasich had let an order from the previous administration banning the sale and purchase of exotic animals expire this spring, arguing it "had no teeth" and would have been impossible to enforce.

A stakeholders' group has been working to draft permanent legislation on the issue.

Federal documents show the owner of dozens of wild animals who freed them before killing himself was an avid gun collector who had traded weapons for a monkey, a leopard and a tiger cub.

Terry Thompson built his collection of exotic animals by swapping guns, sheltering animals no longer wanted by their owners and buying others at auctions, according to public records released Friday and interviews with those who knew him.

"Once you have an exotic animal, you're somewhat tagged as someone who will take unwanted or abandoned animals. And that's how it grew," Thompson said, according to a deposition that was part of the government's attempt to seize 133 weapons from him.

No one knows for sure why Thompson freed 56 animals including lions, tigers and bears on Tuesday and then committed suicide, triggering a big-game hunt in the Ohio countryside as police officers shot and killed 48 of them for fear they would harm humans. A 49th animal was killed by one of the big cats. The remaining animals were captured and taken to the Columbus Zoo.

The frightening situation put a spotlight on the lack of oversight on exotic pets in some states. Ohio has some of the nation's weakest restrictions.

Deputies killed 18 rare Bengal tigers, 17 lions and eight bears in a hunt across eastern Ohio that has been criticized by some who say the animals should have been saved. The officers were ordered to kill the animals instead of trying to bring them down with tranquilizers for fear that those hit with darts would escape in the darkness before they dropped and would later regain consciousness.

Over the years, neighbors complained about a lion running loose and regularly called the sheriff about Thompson's horses roaming away from the property where the wild animals were kept.

Thompson, 62, had his share of troubles in the last year. He owed thousands of dollars in unpaid taxes, had marital problems and just returned home only a few weeks ago after spending a year in federal prison for possessing unregistered weapons.

A week before Thompson killed himself, a sheriff's deputy visited his farm because a neighbor complained about his horses getting out again.

Thompson promised he'd check the fences and admitted he was struggling to take care of all the animals, authorities said.

"Terry stated to me that he had just recently got home out of prison and he has not had very good control over any of his animals since he had been locked up," the deputy wrote in a report released Friday.

Thompson's estranged sister said he likely was overwhelmed financially when he committed suicide.

"I can just see him standing on that hill looking at every animal, thinking, 'How am I going to do this?'" Polly Thompson told The Associated Press. "And I'm sure he thought, 'Nobody wants me.'"

Terry Thompson got by financially on proceeds from a motorcycle business he sold, sales of horse trailers and other equipment and a small family inheritance. He also was a pilot who occasionally flew chartered planes for businesses.

Polly Thompson reluctantly testified against her brother about five years ago when he was charged with starving bison and cattle kept at their parents' farm near Zanesville.

"Anybody that has animals should take care of them," she said in an interview at her home on the outskirts of Zanesville.

Terry Thompson was a gun dealer in Zanesville for many years but told federal authorities he never hunted, according to court records. "Absolutely unequivocally not a hunter," he said.

His wife, Marian Thompson, told investigators that they never sold the animals or opened the farm to visitors.

"We don't want them on display," she said.

She told detectives in the past that they took in the animals because no one else wanted them. She also said she was trying to end the practice.

"I'm going to put a stop to bringing in all these animals. I'm telling Terry, 'No more,'" she said in a report filed in April 2005.

Authorities and animal experts went to the farm three years ago during a cruelty to animals investigation and found that some of the cages weren't padlocked and a few were secured with plastic ties that had been partially chewed, according to the records released by the Muskingum County Sheriff's Office.

The director of animal management from a wildlife preserve in Ohio said the bottoms of fences weren't secured and gates meant for dog kennels were used in pens housing the big cats. He also noted that a cage housing two lions should have had a much higher fence.

"There was also a tree in this cage area, and there was nothing to prevent the animal from climbing the tree and escaping," a report said.

Animal pens were scattered on the patio and driveway of the Thompsons' home on the property, and there were several others inside the garage and basement. They had a black leopard in the basement and two tigers and two lion cubs in the garage.

On a patio next to the Thompsons' pool, two lion cubs and one black bear cub were in the same pen.

A veterinarian from Columbus Zoo saw that a tiger was missing its tail and thought it had been ripped or bitten off by another animal in an adjoining cage. Two tigers were in a cage filled with standing water, rotting carcasses and lots of bones.

The zoo officials also expressed concerns about malnutrition and the sizes of the pens.

Thompson also kept a monkey in a cage too small for it to stand up in, kept a wolf in an old car and had a zebra in a horse trailer, said a Muskingum County resident familiar with Thompson who saw the conditions and spoke with the AP on condition of anonymity for fear of repercussions over the comments.

Authorities decided not to take the Thompsons' animals because there were no serious health problems but told the couple to fix the cages or they would get a court order forcing the changes.

Within three weeks, taller fences had been constructed. A county prosecutor then told detectives there was little else they could do because they had no authority to regulate anyone who keeps wild or exotic animals.

Even after the changes, detectives wrote in their final report that "it is impossible for the sheriff's office to say the Thompson property is safe."

(Reuters) ? South Africa's slowly dying textile industry could receive a shot in the arm from a burgeoning fashion market in Africa's largest economy that is looking for home-grown fabric and stitching for its internationally known designers.

The 8th Africa Fashion week in Johannesburg this week brought together the glamour and chaos of countless fashion shows and the hopes of thousands of jobless textile workers living in poverty.

The textile industry for decades had been a mainstay of Africa's biggest economy until about 20 years ago when cheaper imports from Asia began saturating the market, with factories closing down.

"There have been about 160,000 jobs lost in the industry since 1996, the height of employment in the industry. However, the rate of job losses appears to be slowing down," said South African Textile Workers Union (SACTWU) researcher Simon Eppel.

The number of workers brought back to work from an African fashion success is still small but workers are hoping that as African designers gain in global stature, more jobs will return.

Thula Sindi, an established South African designer showing his line at fashion week, uses co-operatives of skilled seamstresses in the factory areas of Johannesburg to produce many pieces in his line.

"The good thing about co-ops is that you are outsourcing to smaller factories in the city. We work according to demand. It's one way to create and save jobs because the advantage is being able to deliver clothes on time," Sindi said.

To encourage more of these tie-ups, a trade expo was launched concurrently with the fashion week to bring designers, retailers and manufacturers together.

"In the rest of the world, high-end designers with their own businesses contribute hugely to the GDP. In South Africa we don't have a developed base yet for these designers to have such a great share," said Grant Blackbeard, general manager of African Fashion International.

The swimwear and lingerie line from Durban-based Dax Martin had an ocean theme produced by local craftsmen. His works have been used in global beauty contests and sold internationally.

Blackbeard said designers branching out globally should think about producing locally.

"We have to look at the starting point which is fabric. With a lot of our mills being put out of business from the cheaper Chinese fabrics coming in, we need to strengthen our mills so we don't have to purchase our raw materials from abroad."

Rep. Jaime Herrera Beutler (R-Wash.) asked a local paper not to publicize her town hall meeting out of concern that it would attract protesters, a new report says.

One of Herrera Beutler?s staffers contacted the Washington newspaper The Chronicle to invite them to cover a town hall meeting. However, the office requested that the newspaper not announce the details in advance of the town hall, according to another local newspaper, The Columbian.

The Chronicle declined that request and published an announcement in Saturday?s paper.

Herrera Beutler?s office justified the move by saying that they were concerned that publicizing the event would attract protesters, especially from outside the district.

?In our experience, when we put out a press release and announce such events well in advance, interest groups ? often from outside the district ? use the information to organize and follow the congresswoman from event to event to dominate the conversation, and local residents lose out,? Casey Bowman, Herrera Beutler?s communications director, wrote in an email to The Chronicle.

Bowman also stressed in that same email that they did not screen for favorable constituents to invite to meetings.

?Our focus is on giving everyone in Southwest Washington a chance to say what?s on their mind to their representative in Congress. Recently, we?ve stuck to phone calls to invite people ? but we do not screen who we invite within a community. Period,? he said.

Herrera Beutler faced a loud and divided crowd in a town hall meeting in May 2011. The meeting involved hostile questioning on her vote on the Paul Ryan budget plan and her views on the federal debt limit, which led to both applause and boos in the crowd, according to a The Columbian report at the time.

Herrera Beutler?s public meetings are not always been so controversial, however. In fact, thirty job seekers were hired after the congresswoman held a jobs fair in September.

As the 22nd overall pick in last year?s NFL draft, Broncos receiver Demaryius Thomas was a major disappointment, catching just 22 passes for 283 yards in his rookie year.

And so far this year Thomas has done even less.

Thomas has had injuries to his foot, ankle, Achilles tendon, hand and head, and he hasn?t even been able to get into a game yet this season. Thomas knows people are already calling him the B-word, and he says he?s been concerned that the Broncos might release him.

?I?ve been stressing, really, feeling that frustration, that I could have been cut,? Thomas told the Denver Post. ?I was worried about that, actually. I don?t want to be that guy they say that?s injury prone. I?ve already had three injuries since I?ve been in the league that set me back. I don?t want to get here and be that bust. I told my mother this and I told my family this. I told them I was going to be the guy who had success. I just want to stick to what I say.?

The Broncos hope Thomas can finally produce, which is one of the reasons they traded starting receiver Brandon Lloyd. Thomas thinks he can repay that confidence by becoming the team?s No. 1 receiver.

?I still want to be that guy,? Thomas said. ?I think I?m ready to be that guy. I?ve been saying this, but this is the healthiest I?ve been, right now, since I?ve been in the league.?

Broncos coach John Fox says he sees Thomas?s potential. But Fox also pointed out that he?s not the one who drafted Thomas.

?He has size, speed, strength, a lot of the things you look for,? Fox said. ?That?s probably why he was selected as high as he was, and we?re looking forward to getting him back.?

Fox?s phrasing ? ?that?s probably why he was selected as high as he was? ? is interesting. It suggests that Fox isn?t sure that Thomas was really worth a first-round draft pick, but now that Fox has Thomas on his team, he feels like he has little choice but to give Thomas a shot.

The same could be said for the Broncos? other first-round draft pick last year, Tim Tebow. Maybe Tebow-to-Thomas will become the Broncos? pass-catch combination for years to come, and the Josh McDaniels era won?t look so bad in hindsight.

Or maybe Fox will end up cursing the day he inherited a couple of first-round busts.

Divorce and remarriage affect beliefs about who should care for elder relatives

COLUMBIA, Mo. America's elderly population will nearly double by 2050, according to a Pew Research report. As baby boomers enter retirement, concern exists as to who will care for them as they age. Traditionally, children have accepted the caregiving responsibilities, but those caregiving roles are becoming blurred as more families are affected by divorce and remarriage than in previous decades. Now, University of Missouri researchers have found that relationship quality trumps genetic ties when determining caregiving obligations.

Lawrence Ganong, a professor and co-chair in the MU Department of Human Development and Family Studies in the College of Human Environmental Sciences (HES), studied how divorce and remarriage affect beliefs about who should care for aging relatives. He found that relationship quality, a history of mutual help, and resource availability influence decisions about who cares for parents and stepparents.

"The idea that family obligations are based on genetic ties is not true for most Americans," Ganong said. "How close family members are to each other, how much they have been helped by them in the past, and what hardships caregiving might place on family members are important factors when people consider caring for older kin."

Ganong and Marilyn Coleman, Curators' Professor in HES, presented study participants with hypothetical caregiving scenarios involving an aging parent or stepparent and a child or stepchild. Participants then responded to questions about their perceptions of who should provide care. The majority of participants said biological factors are relevant in caregiving decisions, but they do not automatically require adult children to help older relatives.

"Based on what happens before, during and after marital transitions, family members may change what they think their responsibilities are regarding helping and providing care to kin," Ganong said. "As a society that relies on families to provide much of the care for older adults, we need to better understand the effects of changes in families due to divorce and remarriage."

Ganong recommends that middle-aged adults have honest conversations with parents and stepparents about expectations for caregiving and other types of assistance before needs arise.

Ganong presented the paper, "Who Gets Custody of Grandma After the Divorce? How Marital Transitions Affect Family Caregiving Responsibilities," at the 10th International Family Nursing Conference in Kyoto, Japan, earlier this year. Ganong has a joint appointment as a professor in the MU Sinclair School of Nursing. The research was funded by the National Institute on Aging, part of the U.S. National Institutes of Health.

(AP) ? Presidential hopeful and pizza executive Herman Cain says he "won't be a flavor of the week" and his sudden climb to the top of GOP presidential polls will last.

A recent spate of polls showed Cain joining Mitt Romney and Rick Perry in the top GOP tier.

Cain said Sunday that his signature 9-9-9 tax plan would lower taxes for most Americans, but conceded some middle-class-Americans might pay more. The plan would scrap the current federal tax code and replace it with 9% rates for personal income and corporate taxes and add a 9% national sales tax.

Many independent analysts say Cain's plan would lower taxes on the rich and raise them for many middle class Americans, but the Georgia businessman disputed those doubts on NBC's "Meet the Press."

More Children Visiting ERs for Psychiatric Care (HealthDay)

FRIDAY, Oct. 14 (HealthDay News) -- A growing number of American children are receiving psychiatric care in hospital emergency departments, particularly children who have no insurance or are covered by Medicaid.

That's the finding of a new study that examined 279 million visits made by children to U.S. emergency departments from 1999 to 2007.

During that time, the rate of psychiatric visits increased from 2.4 percent to 3 percent. Underinsured children accounted for 46 percent of those visits in 1999 and 54 percent in 2007.

The findings, slated to be presented Friday at the American Academy of Pediatrics National Conference and Exhibition in Boston, are important for a number of reasons, according to study author Dr. Zachary Pittsenbarger.

As expected, the results show that psychiatric visits by children to emergency departments continue to increase.

"A second, and more novel finding, is that one group in particular is increasing beyond any other socio-demographic group, and that is the publicly insured," Pittsenbarger said in an AAP news release.

"It has been found previously that the publicly insured have fewer treatment options and longer wait times for psychiatric disorders when not hospitalized," he noted. "This new finding argues that limited outpatient mental health resources force those patients to seek the care they need in the emergency department."

Because this study was presented at a medical meeting, the data and conclusions should be viewed as preliminary until published in a peer-reviewed journal.

UK: Slay plot an escalation of Iran's terror ties

(AP) ? The alleged plot to kill Saudi Arabia's ambassador to the U.S. marks an escalation of Iran's sponsorship of terrorism overseas, Britain's foreign secretary said Thursday, as Europe and others discussed their response.

William Hague told lawmakers that Britain was working with the U.S., Saudi Arabia and the European Union to agree on tough international action over the purported plan to assassinate Adel Al-Jubeir in a bombing at his favorite Washington restaurant.

FBI Director Robert Mueller says many lives could have been lost in the plot to kill the Saudi envoy. In Washington, President Barack Obama told a news conference Thursday that the U.S. can support all of the allegations of an assassination plot.

A U.S. criminal complaint accuses two Iranian suspects of hiring a would-be assassin in Mexico ? who also was a paid informant for the U.S. Drug Enforcement Administration and told U.S. authorities about the details of the plot.

Manssor Arbabsiar, a 56-year-old U.S. citizen who also holds an Iranian passport, was charged along with Gholam Shakuri, who authorities said was a Quds Force member and is still at large in Iran.

"This would appear to constitute a major escalation in Iran's sponsorship of terrorism outside its borders," Hague told the House of Commons on Thursday. "We are in close touch with the U.S. authorities and will work to agree an international response, along with the U.S., the rest of the EU and Saudi Arabia."

Britain had previously accused Iran of supplying weaponry and assistance to attacks against U.K. forces in Afghanistan and Iraq, and of arming other militias in the Middle East.

Hague said Britain was aware of "indications that this deplorable plot was directed by elements of the Iranian regime, with the involvement of senior members of the Islamic Revolutionary Guard Corp's Quds Force."

In Vienna, Saudi Arabia's foreign minister accused Tehran of "murder and mayhem" and said his country was working on a "measured response" to the alleged Iranian attempt to assassinate Riyadh's ambassador.

"We will not bow to such a pressure," Foreign Minister Prince Saud al-Faisal told reporters. "We hold them accountable for any action they take against us."

The Saudi-headquartered Gulf Cooperation Council joined in condemning the alleged assassination attempt, saying that it was harmful to relations between the six GCC-member countries and Iran. In other critical comments, the Arab League said any attack on diplomats would undermine efforts to achieve international peace and security in the region, and strain relations between Arab Gulf countries and Iran.

Other European nations also called for action over the alleged plot.

Germany's Foreign Minister Guido Westerwelle has demanded an explanation from Tehran over the alleged plot, the country's foreign ministry said in a statement.

"Indications of the involvement of Iranian government agencies cause even greater concern," the ministry said. "The federal government calls upon the Iranian government for a comprehensive explanation of the allegations. Those who took part the attack plans and their backers must be held accountable."

Meanwhile, in an initial cautious comment, Italy said that if the U.S. allegations were confirmed there could be "serious consequences" for Iran.

"If the facts are confirmed, they would constitute a grave responsibility which could bring about serious consequences," said a brief statement from Italian Premier Silvio Berlusconi's office.

Italy for years was Iran's No. 1 trading partner in the European Union with a strong presence in Iran's gas market through its oil and gas giant Eni SpA. But under pressure to isolate Tehran over its disputed nuclear program, Italy in recent years trimmed back its commercial ties. Eni announced last year it was pulling out entirely after current contracts expire.

Hague said Britain would work with allies to agree on new sanctions ? likely to include travel bans and asset freezes ? against those linked to the plot.

However, diplomats have indicated Britain would not support any calls for military action.

One of the five Iranians made the subject of sanctions by the U.S. Treasury on Tuesday, a Quds commander called Qasem Soleimani, is already named in United Nations and European Union sanctions related to Iran's nuclear program.
